Draft Home Sewage Treatment Systems Wastewater Discharge General Permit

Ohio EPA has issued a draft general National Pollutant Discharge Elimination System (NPDES) Permit No. OHK000005 that may provide coverage to discharges from select household sewage treatment systems (HSTS) serving one, two, or three family dwellings or other residential dwellings as defined by Ohio Administrative Code (OAC) 3701-29 in the state of Ohio.

The draft general NPDES permit was issued Sept. 24, 2026. Ohio EPA developed this draft general NPDES permit in consultation with the Ohio Department of Health (ODH) and a workgroup comprising local health districts. The issuance of this draft general NPDES permit addresses the renewal of the existing NPDES Permit No. OHK000004, which expires on Dec. 31, 2026. Draft general NPDES Permit No. OHK000005 does not increase permit limitations, nor does it expand the universe of potential new or increased discharges contemplated under general NPDES OHK000004.

Renewal under this general permit will not require a notice of intent under OAC 3745-38-02(F). There are currently greater than 28,000 HSTS covered under the general permit. These facilities are all similar in nature discharging treated sewage from domestic sources at quantities less than 1,000 gallons per day.

Ohio EPA shares the authority to manage these discharges with ODH and local health districts. The treatment systems are approved by ODH to meet the conditions of this permit. Submitting a notice of intent would not provide any additional information to Ohio EPA that is necessary to renew coverage, and there is no fee associated with the renewal. In lieu of a notice of intent, the existing permits will be renewed upon permit issuance, and the homeowners will be notified of the renewal. In the notification, instructions will be included to help homeowners update any inaccurate information associated with the permit via a transfer form. Copies of the draft general NPDES permit, its associated fact sheet, and further documentation can be obtained online.
