Early Stakeholder Outreach — Definitions, Applicability, and Compliance Deadlines for Ohio’s NOx RACT Regulations
What do OAC rules 3745-110-01, 3745-110-02, and 3745-110-04 cover?
Rule 3745-110-01 of the Ohio Administrative Code (OAC) establishes the definitions of language used in Chapter 110 Nitrogen Oxide (NOx) Reasonably Available Control Technology (RACT). OAC rule 3745-110-02 establishes the applicability of emissions regulations for stationary sources of NOx emissions. OAC rule 3745-110-04 establishes compliance deadlines for stationary sources of NOx emissions.
Why are these rules being sent out for Early Stakeholder Outreach?
The first step in the rule-making process is for Ohio EPA to identify that a rule needs to be amended, rescinded, or created. Ohio EPA has added an additional step to ensure stakeholders are brought into the rule process as early as possible. This additional interested party notification and request for information will allow for early feedback before the rule language has been developed by the Agency.
What changes are being considered?
Ohio EPA will update the definition of potential to emit in OAC rule 3745-110-01 to provide additional clarity regarding RACT applicability calculations. Ohio EPA will correct errors from amendments during a prior rule-making and better identify historical and current applicability to the requirements of the chapter in OAC rule 3745-110-02 and 3745-110-04. The change will correct the applicability back to the original intent of how the requirements in Chapter 110 apply to existing, new, or modified stationary sources of NOx emissions.
Written comments will be accepted through close of business March 20, 2026.
