RULES: Contingency Plan - Early Stakeholder Outreach
What does OAC Chapter 3745-85 cover?
DDAGW has reviewed 3745-85-01 of the Ohio Administrative Code (OAC) to satisfy the five-year rule review requirements of section 106.03 and 106.031 of the Ohio Revised Code. This rule sets forth the requirements for a public water system’s contingency plan. The rule establishes the required content, storage, and submittal of a contingency plan.
Why are these rules being sent out for Early Stakeholder Outreach?
The first step in the rule-making process is for Ohio EPA to identify that a rule needs to be amended, rescinded, or created. Ohio EPA has added an additional step to ensure stakeholders are brought into the rule process as early as possible. This additional interested party notification and request for information will allow for early feedback before the rule language has been developed by the agency.
What changes are being considered?
Ohio EPA is considering proposing this rule as “amend” with the following changes:
· Minor language corrections to improve clarity and continuity and eliminate redundancy throughout the
rule.
· Adding emergency contact information for SCADA contractor or internal IT personnel.
· Adding requirement for cyber incident reporting.
· Adding new circumstance to address supply chain shortages.
Who is regulated by these rules?
This rule applies to all community and wholesale public water systems.
What is the rulemaking schedule?
After the evaluation of early stakeholder feedback, this rule package will be sent to interested party review. After incorporating interested party comments, Ohio EPA will start the rule filing process required by the Joint Committee on Agency Rule Review (JCARR).
How can I provide input?
The agency is seeking stakeholder input on these rules. When preparing your comments, be sure to:
· explain your views as clearly as possible;

Written comments will be accepted until 5 p.m. on June 19, 2026.
