RULES: Pretreatment (OAC Chapter 3745-3) - Early Stakeholder Outreach
What does OAC Chapter 3745-3 cover?
OAC Chapter 3745-3 applies to (a) Publicly Owned Treatment Works with approved pretreatment programs and (b) POTWs working toward obtaining approval for a pretreatment program. This chapter contains the requirements for the development and implementation of pretreatment programs.
What changes are being considered?
· Add new requirements for Centralized Waste Treatment facilities and other facilities that take off-site wastes, including septage treatment systems. The changes would require these facilities to maintain records of off-site wastes.
· Addition of the Upset and Bypass language in 40 CFR 403.16 and 40 CFR 403.17, respectively.
· Minor changes including clarifications and updates to rule references. These minor changes are consistent with the federal pretreatment regulations in 40 CFR 403.
Written comments will be accepted until 5 p.m. on May 1, 2026.
