RULES: Nutrient Assessment Protocol Implementation (OAC 3745-33-01 and -06)
What does OAC Chapter 3745-33 cover?
Chapter 3745-33 of the Ohio Administrative Code (OAC) contains rules for the administration and technical requirements for writing and obtaining wastewater discharge permits under the National Pollutant Discharge Elimination System (NPDES) permit program. This chapter contains requirements for NPDES applications, permit actions, authorized discharge levels, treatment and disposal standards and permit limits, generic permit conditions, and best management practices.
What types of changes are being considered?
The agency is conducting the five-year review of OAC 3745-33-06 and considering the addition of new paragraphs regarding an implementation process related to the Stream Nutrient Assessment Protocol (SNAP). The intent of the rulemaking is to formalize a structure to determine what, if any, NPDES permit conditions are appropriate when Ohio EPA has determined that a discharger’s receiving stream or river is impaired or at risk of becoming impaired for the aquatic life use due to excessive nutrients. A concurrent rulemaking effort for OAC Chapter 3745-2 to incorporate the SNAP addresses how this determination would be made.
