DDAGW has reviewed 3745-91 of the Ohio Administrative Code (OAC) to satisfy the five-year rule review requirements of section 106.03 and 106.031 of the Ohio Revised Code. These rules set forth the plan requirements for community public water systems that serve political subdivisions or investor-owned public entities.
Why are these rules being sent out for Early Stakeholder Outreach?
The first step in the rule-making process is for Ohio EPA to identify that a rule needs to be amended, rescinded, or created. Ohio EPA has added an additional step to ensure stakeholders are brought into the rule process as early as possible. This additional interested party notification and request for information will allow for early feedback before the rule language has been developed by the agency.
What changes are being considered?
Proposed amendments include:
· Adding updates to protection plan components.
· Adding language to include surface water public water systems.
· Minor language revisions for overall rule clarity.
Who is regulated by these rules?
This rule applies to community public water systems in Ohio that provide for political subdivisions or are investor-owned public entities.
What is the rulemaking schedule?
After the evaluation of early stakeholder feedback, OAC 3745-91-10 and 3745-91-12 will be sent to interested party review. After consideration of interested party comments, Ohio EPA will start the rule filing process required by the Joint Committee on Agency Rule Review (JCARR).
