Interested Party Review — Consumer Confidence Report Rules


What does this rule package cover?
DDAGW has reviewed the Consumer Confidence Report rules in chapter 3745-96 of the Ohio Administrative Code (OAC) to satisfy the five-year rule review requirements of section 106.03 of the Ohio Revised Code. The rules describe and establish the minimum requirements for the content of the annual report that a community water system shall deliver to its customers.

What step is this in the rulemaking process?
This step in Ohio EPA’s rulemaking process, required by Ohio Revised Code (ORC) 121.39, is called Interested Party Review. During this step, the Agency makes available draft rules for interested parties for review and comment. This step occurs after the Early Stakeholder Outreach comment period.

What changes are being considered?
Ohio EPA is considering the following revisions to these rules:
  • Ohio EPA will incorporate all changes as required by the US EPA Revised CCR Rule.
  • Enter into Rule the electronic delivery methods and good faith efforts, consistent with the 2013 USEPA Delivery Options Memo (3745-96-04).
  • Require community water systems serving more than 50,000 to post the CCR on the internet (3745-96-04).
  • To require the reports to include: (3745-96-02)
  • Description of corrosion control efforts.
  • Information on lead service line inventories.
  • Clearly identified lead action level exceedances.
  • Updated required health information (3745-96-03).
  • A summary statement (3745-96-05).
  • Require/facilitate translation assistance to systems serving a large proportion of consumers with limited English proficiency (3745-96-02) and (3745-96-04).
  • Incorporate LCRI requirements (3745-96-02).

Who will be regulated by these rules?
Community public water systems.

What is the rulemaking schedule?
After the 30-day comment period any comments will be reviewed and changes implemented before original filing.

Comments on the draft rules must be received no later than 5 p.m. February 6, 2026.
