Chapter 3745-21 – Carbon Monoxide, Photochemically Reactive Materials,

Hydrocarbons, and Related Materials Standards

 

Notice is hereby given that the Director of Environmental Protection, Division of Air Pollution Control (DAPC), under the authority of Sections 3704.03 of the Ohio Revised Code and in accordance with Chapter 119, proposes to amend some of the rules in Ohio Administrative Code (OAC) Chapter 3745-21, “Carbon Monoxide, Photochemically Reactive Materials, Hydrocarbons, and Related Materials Standards” and recommends no-changes for others.

 

OAC Chapter 3745-21 establishes requirements for the control of emissions of volatile organic compounds (VOCs) and carbon monoxide (CO) from stationary emission sources. VOCs are a precursor compound from which ozone is formed. Ozone is one of the six criteria pollutants for which a National Ambient Air Quality Standard (NAAQS) has been established under the Clean Air Act. CO is also one of the six criteria pollutants for which a NAAQS has been established. The intent of these rules is to limit emissions of VOCs and CO to allow the state of Ohio to attain and maintain the NAAQS for ozone and CO.

 

Ohio EPA is proposing to amend the following rules:

 

3745-21-01     Definitions and incorporation by reference.

3745-21-04     Compliance time schedules.

3745-21-07     Control of emissions of organic materials from stationary sources.

3745-21-09     Control of emissions of volatile organic compounds from stationary sources and perchloroethylene from dry cleaning facilities.

3745-21-10     Compliance test methods and procedures.

3745-21-11     Reasonably available control technology studies for non-CTG sources in ozone nonattainment areas.

3745-21-12     Control of volatile organic compound emissions from commercial bakery oven facilities.

3745-21-13     Control of volatile organic compound emissions from reactors and distillation units employed in SOCMI chemical production.

3745-21-14     Control of volatile organic compound emissions from process vents in batch operations.

3745-21-15     Control of volatile organic compound emissions from wood furniture manufacturing operations.

3745-21-16     Control of volatile organic compound emissions from industrial wastewater.

3745-21-19     Control of volatile organic compound emissions from aerospace manufacturing and rework facilities.

3745-21-20     Control of volatile organic emissions from shipbuilding and ship repair operations (marine coatings).

3745-21-21     Storage of volatile organic liquids in fixed roof tanks and external floating roof tanks.

3745-21-22     Control of volatile organic compound emissions from offset lithographic printing and letterpress printing facilities.

3745-21-23     Control of volatile organic compound emissions from industrial solvent cleaning operations.

3745-21-24     Flat wood paneling coatings.

3745-21-25     Control of VOC emissions from reinforced plastic composites production operations.

3745-21-26     Surface coating of miscellaneous metal and plastic parts.

3745-21-27     Boat manufacturing.

3745-21-28     Miscellaneous industrial adhesives and sealants.

3745-21-29     Control of volatile organic compound emissions from automobile and light-duty truck assembly coating operations, heavier vehicle assembly coating operations, and cleaning operations associated with these coating operations.

 

Ohio EPA has reviewed the following rules and is determining no changes are needed:

 

3745-21-03     Methods of ambient air quality measurement.

3745-21-06     Classification of regions.

3745-21-08     Control of carbon monoxide emissions from stationary sources.

3745-21-17     Portable fuel containers.

3745-21-18     Commercial motor vehicle and mobile equipment refinishing operations.

 

The purpose of this rule making is to conduct a 5-year review of the rules in this chapter to fulfill the requirements of Ohio Revised Code (ORC) 106.03 and 106.031. The rules are part of Ohio’s State Implementation Plan (SIP) for the attainment and maintenance of the Ozone National Ambient Air Quality Standards (NAAQS) as required by the Clean Air Act (CAA). As a result of the review, Ohio EPA has determined that these rules remain necessary and are in need of several updates. These changes involve making various minor changes to update facility names, correct typos and update the rule language in this chapter to meet legislative service commission (LSC) style and formatting guidelines. These changes are being made throughout the chapter, are minor in nature, and do not affect the scope or intent of the rules. Ohio EPA is also making various minor changes to update test method, publication and referenced material titles, effective dates, addresses and web sites. These changes are being made throughout the chapter, are minor in nature, and do not affect the scope or intent of the rules.


Pursuant to Section 121.39 of the Ohio Revised Code, DAPC was required to consult with interested parties affected by the rules before the Division formally adopts them. On July 13, 2026, these rules went out for a 30-day review by interested parties. Pursuant to Part D of Title I of the Clean Air Act, Ohio EPA is required to establish a state implementation plan (SIP) for the attainment and maintenance of the National Ambient Air Quality Standards (NAAQS). The above-mentioned rules and documents are a part of Ohio’s SIP and the proposed amendments will be submitted to USEPA as a modification of the SIP.

 

The public comment period will run until November 13, 2026.  A public hearing on this proposed rulemaking will be held to consider public comments in accordance with Section 106.03 and 106.31 of the Ohio Revised Code. Ohio EPA will be holding an in-person and virtual public hearing on the rules on November 13, 226 at 10:30 am. The in-person hearing will be at the same time and date and will be located at Ohio EPA, Suite 700, 50 W. Town Street, Columbus, Ohio 43215. During the hearing, the public may submit written comments on the record about the proposed rules if participating virtually and verbally if participating in person.

Registration for the in-person hearing is not required. Citizens intending to give testimony at the hearing should notify the Ohio EPA Public Interest Center, P.O. Box 1049, Columbus, Ohio 43216-1049, (614) 644-2160 or by emailing mary.mccarron@epa.ohio.gov. Prior registration will ensure that registrants are heard ahead of those individuals who register at the hearing. Oral testimony may be limited to five minutes, depending on the number of persons testifying. All interested persons are entitled to attend or be represented and to present oral and/or written comments concerning the proposed rule making.

Written comments may also be submitted to the Hearing Officer at the public hearing. Written testimony will receive the same consideration as oral testimony. All testimony received at the hearing or by close of business on November 13, 2026, will be considered by Ohio EPA prior to final action on this rulemaking proposal. Written comments submitted after this date may be considered as time and circumstances permit.
