Why are these rules being sent out for Early Stakeholder Outreach?
The first step in the rulemaking process is for Ohio EPA to identify if a rule needs to be amended, rescinded, or created. This interested party notification and request for information will allow for early feedback for the agency to consider in this rulemaking.
What changes are being considered?
The Division of Materials and Waste Management (DMWM) is reviewing the C&DD groundwater monitoring rule and the C&DD processing facility rules for the five-year review requirement pursuant to Ohio Revised Code (ORC) section 106.03. DMWM is considering the following revisions:
- C&DD processing facilities:
· Correction of typographical errors and language inconsistencies.
· Update the oil and gas well language in OAC 3745-400-52(B)(9) to require well information from the Ohio Department of Natural Resources (ODNR) website in lieu of a letter.
· Incorporation of a new requirement to submit an annual report.
- C&DD landfill groundwater monitoring:
· Correction of typographical errors and language inconsistencies.
· Amendments to ensure consistent referencing of water bearing zones.
· Updates to assessment monitoring to incorporate corrective measures.
· Add new corrective measures rule to be consistent with statute.
Who is regulated by these rules?
OAC Chapter 3745-400 applies to owners and operators of C&DD landfills and C&DD processing facilities.
What is the rulemaking schedule?
After consideration of stakeholder input, Ohio EPA will prepare draft rules for interested party review and comment.
Written comments will be accepted through close of business June 26, 2026. Please submit input below.
