Secondary Maximum Contaminant Level - Interested Party Review
What does this rule package cover?
The Division of Drinking and Ground Waters (DDAGW) has reviewed the Secondary Maximum Contaminant Levels rules in Chapter 3745-82 of the Ohio Administrative Code (OAC) to satisfy the five-year rule review requirements of section 106.03 of the Ohio Revised Code. OAC Chapter 3745-82 establishes the secondary maximum contaminant level and how to remain in compliance.
What step is this in the rulemaking process?
This step in Ohio EPA’s rulemaking process, required by Ohio Revised Code (ORC) 121.39, is called Interested Party Review. During this step, the Agency makes available draft rules for interested parties for review and comment. This step occurs after the Early Stakeholder Outreach comment period.
What changes are being considered?
OAC 3745-82-03, and -04 are being proposed with no changes. Proposed amendment to OAC 3745-82-01 include removing a regulatory restriction from paragraph (A). Proposed amendments to OAC 3745-82-02 include the addition of copper at 1.0 mg/L and lowering the pH range level to 6.5-8.5.
Who will be regulated by these rules?
Ohio Public Water Systems.
What is the rulemaking schedule?
After the 30 day comment period any comments will be reviewed and changes implemented before original filing.
Comments on the draft rules must be received no later than 5 p.m. March 4, 2026.
