RULES: Cuyahoga River Drainage Basin (OAC 3745-1-26) - Proposed Rule
Which rules are under review?
This rulemaking includes only one rule, the Cuyahoga river drainage basin. This rule indicates the beneficial use designations for water bodies in the Cuyahoga River watershed.
Why is this rule under review and what types of changes are being considered?
Rule 3745-1-26 is under review to comply with the state requirement to review rules every five years.
The main changes being considered are:
1) Removing the definition for the L symbol as limited warmwater habitat, as this designation is being phased out and does not apply to any water bodies in this rule.
2) Removing all text referring to the Cuyahoga ship channel, as well as Table 26-1 which applies to the Cuyahoga ship channel.
3) Adding new segments to the use designation table, including segments of the mainstem Cuyahoga river.
4) Name changes to bring the rules into alignment with the federal names of water bodies.
