RULES: Long Term 2 Enhanced Surface Water Rule - Interested Party Review
What does this rule package cover?
DDAGW has reviewed rules 3745-81-31, 3745-81-64, 3745-81-67, 3745-81-68 and 3745-81-69 of the Ohio Administrative Code (OAC) to satisfy the five-year rule review requirements of section 106.03 of the Ohio Revised Code. The rules describe and establish the general requirements for treatment techniques and recordkeeping for systems treating surface water.
What step is this in the rulemaking process?
This step in Ohio EPA’s rulemaking process, required by Ohio Revised Code (ORC) 121.39, is called Interested Party Review. During this step, the Agency makes available draft rules for interested parties for review and comment. This step occurs after the Early Stakeholder Outreach comment period.
What changes are being considered?
Ohio EPA is considering the following revisions to these rules:
· 3745-81-31 and 3745-81-64 are being proposed as no change.
· 3745-81-67
o Updating references.
o Changing “crypotosporidium” to “cryptosporidium”.
o Removing March 1, 2010 deadlines.
o Removing the Cryptosporidium Treatment Compliance Dates Table.
· 3745-81-68
o Removing references to 3745-81-67.
o Minor grammar corrections.
o Removing references to finalized programs in 2006.
o Updating references.
o Updating links.
· 3745-81-69
o Updating references.
o Updating the Microbial Toolbox Reporting Requirements schedule to “Upon intent”, “watershed control plan is approved” and “in the schedule as approved by the director”.
Who will be regulated by these rules?
All public water systems that are using surface water as their source in whole or in part.
What is the rulemaking schedule?
After the 30 day comment period any comments will be reviewed and changes implemented before original filing.
