Notice is hereby given that the Director of Environmental Protection, under the authority of Sections 6109.04 and 6109.121 of the Ohio Revised Code and in accordance with Chapter 119, proposes to amend the following rule of the Ohio Administrative Code:

3745-96-05 Summary of report contents.
This rule has been reviewed pursuant to the five-year rule requirements set forth in ORC
106.03 and 106.031. Proposed revisions include:
• 3745-96-01:
o Adding the general requirement for systems serving more than 100,000 persons to provide a plan providing assistance to consumers with limited English proficiency.
o Adding clarifying language to the definition of “customer”.
o Updating rule references.
• 3745-96-02:
o Incorporating LCRI requirement
o Requiring the reports to include, a description of corrosion control efforts, information on lead service line inventories, clearly identified lead action level exceedances, required health information, and a summary statement.
o Requiring translation assistance to consumers with limited English proficiency.
• 3745-96-03:
o Updating the required language about arsenic, nitrate, and lead.
• 3745-96-04:
o Adding the electronic delivery methods and good faith efforts, consistent with the 2013 USEPA Delivery Options Memo.
o Requiring community water systems serving more than 50,000 to post the CCR on the internet.
o Requiring biannual delivery of the CCR for systems serving more than 10,000.
o Requiring translation assistance to consumers with limited English proficiency.
• 3745-96-05:
o Defining the summary statement required at the beginning of the reports.
The public comment period will run until (date). A public hearing on this proposed rulemaking will be held to consider public comments in accordance with Section 119.03 of the Ohio Revised Code. Ohio EPA will be holding an in-person and virtual public hearing on the rules on (date, and time). The in-person hearing will be at the same time and date and will be located at Ohio EPA, Suite 700, 50 W. Town Street, Columbus, Ohio 43215. During the hearing, the public may submit written comments on the record about the proposed rules if participating virtually and verbally if participating in person.

Registration for the in-person hearing is not required. Citizens intending to give testimony at the hearing should notify the Ohio EPA Public Interest Center, P.O. Prior registration will ensure that registrants are heard ahead of those individuals who register at the hearing. Oral testimony may be limited to five minutes, depending on the number of persons testifying.
