The agency is conducting the five-year review of OAC 3745-33-06 and adding new paragraphs regarding an implementation process related to the Stream Nutrient Assessment Protocol (SNAP). The intent of the rulemaking is to formalize a structure to determine what, if any, NPDES permit conditions are appropriate when Ohio EPA has determined that a discharger’s receiving stream or river is impaired or at risk of becoming impaired for the aquatic life use due to excessive nutrients.
Rule OAC 3745-33-01 is also undergoing its five-year rule review and new definitions associated with the SNAP are being incorporated into this rule.
