Ohio EPA has received an application for and is developing Clean Water Act Section 401 water quality certifications for Nationwide Permits as originally proposed in the June 18, 2025, Federal Register (Volume 90, No. 116) and listed in Ohio EPA's public notice.
Discharges from the activity, if approved, would result in degradation to, or lowering of, the water quality of surface waters of the state, including wetlands, streams and lakes. In accordance with OAC rule 3745-1-05, an antidegradation review of the application will be conducted before deciding whether to allow a lowering of water quality. No exclusions or waivers, as outlined by OAC rule 3745-1-05, apply or may be granted.
Copies of the application and the draft certification may be inspected on Ohio EPA's website. Ohio EPA will hold a public information session and public hearing related to issues of lower water quality on October 27, 2025, at 2 p.m. at the State Library of Ohio Boardroom, 274 E. First Ave, Columbus OH 43201. The public hearing will end when all interested parties have had an opportunity to provide comments. The hearing may also be attended virtually by registering online.
