Public Notice - Proposed Rulemaking Governing Wastewater Permits to Install (PTIs)

Notice is hereby given that the Director of Environmental Protection, under the authority of Sections 6111.03, 6111.04, 6111.44, 6111.45, 6111.451, and 6111.46 of the Ohio Revised Code and in accordance with Chapter 119, proposes to original file the following rules of the Ohio Administrative Code:

3745-42-01 Definitions.
3745-42-02 Applicability, exemptions and procedures.
3745-42-03 Requirements for applications and engineering plans.
3745-42-04 Criteria for decision by the director and political subdivision or investor-owned public utility agreements.
3745-42-05 Design flow and waste strength requirements for treatment works sized for one hundred thousand gallons per day or less.
3745-42-06 General permit to install.
3745-42-07 Best available technology for connection into sanitary sewers and centralized collection and treatment of sewage, industrial
waste and other waste.
3745-42-08 Isolation distance requirements.
3745-42-11 Holding tanks.

These rules address the Permits to Install program. The purpose of this rule making is to conduct the five year rule review of these nine
rules.

The public comment period will run until September 25, 2025. A public hearing on this proposed rulemaking will be held to consider public comments in accordance with Section 119.03 of the Ohio Revised Code. Ohio EPA will be holding an in-person and virtual public hearing on the rules on Thursday, September 25, 2025, at 1:30pm. The in-person hearing will be at the same time and date and will be located at Ohio EPA, Suite 700, 50 W. Town Street, Columbus, Ohio 43215. During the hearing, the public may submit comments on the record regarding the proposed rules.

Registration for the in-person hearing is not required. Citizens intending to give testimony at the hearing should notify the Ohio EPA Public Interest Center, P.O. Box 1049, Columbus, Ohio 43216-1049, (614) 644-2160 or by emailing mary.mccarron@epa.ohio.gov. Prior registration will ensure that registrants are heard ahead of those individuals who register at the hearing. Oral testimony may be limited to five minutes, depending on the number of persons testifying. All interested persons are entitled to attend or be represented and to present oral and/or written comments concerning the proposed rule making.

Written testimony should be submitted in the comment box below. Written comments may also be submitted to the Hearing Officer at the public hearing. Written testimony will receive the same consideration as oral testimony. All testimony received at the hearing or by close
of business on September 25, 2025, will be considered by Ohio EPA prior to final action on this rulemaking proposal. Written comments submitted after this date may be considered as time and circumstances permit.
