What do these rules cover?
Ohio Administrative Code (OAC) Chapter 3745-560 contains the requirements for solid waste composting facilities.
Why are these rules being amended and what changes are being considered?
Ohio EPA is required by section 106.03 of the Ohio Revised Code to review the Agency’s rules every 5 years to determine whether to continue the rules without change, amend the rules, or rescind the rules.
The Agency has reviewed the current rules and would like input on the following proposed revisions:
Continuation of composting registrations. Currently, composting registrations do not expire. Incorporating an annual continuation aspect in conjunction with the annual report allows Ohio EPA a better understanding of the scope of operating composting facilities in the state. There are no associated fees with the continuation of the registration, ensuring a minimal adverse impact to business.
The requirement to submit the most recent plan view drawing with the annual report.
A new operator certification program to ensure uniform application of operational practices at all composting facilities and to meet the requirements of division (L) of ORC section 3734.02.
Inclusion of the siting criteria setback from occupied dwellings for composting facilities with materials placement areas located within buildings.
The requirement that initial acceptance of feedstocks, bulking agents, or additives cannot occur until written concurrence is received from Ohio EPA.
Additional amendments to provide plain language and meet formatting guidelines established by the Legislative Service Commission.
