This package will rescind and replace, add, amend, and review rules in the hazardous waste management program in these Ohio Administrative Code (OAC) Chapters: 3745-50 (general requirements and permitting); 3745-51 (identification and listing of hazardous waste); 3745-52 (generator standards); 3745-53 (transporter standards); 3745-54, 3745-55, and 3745-205 (general facility standards); 3745-65, 3745-66, and 3745-256 (interim facility standards); 3745-266 (management of specific types of hazardous waste); 3745-267 (standardized permitting); 3745-270 (land disposal restrictions); 3745-273 (universal waste standards), and 3745-279 (land disposal restrictions).
What step is this in the rulemaking process?
This step in Ohio EPA’s rulemaking process, required by Ohio Revised Code (ORC) 121.39, is called Interested Party Review (IPR). During this step, Ohio EPA makes available draft rules for interested parties for review and comment. This step occurs after the Early Stakeholder Outreach comment period.
What changes are being considered?
Ohio EPA’s hazardous waste management rules are required to be functionally equivalent to their federal counterpart provisions (40 CFR Parts 260 to 279) under the Resource Conservation and Recovery Act, as those provisions are promulgated in the Federal Register (FR). This rules package is designed to address several concepts that are new to the Ohio rules (some Import-Export provisions, some E-manifest requirements, certain hydrofluorocarbons and substitutes), and update the Ohio rules for provisions as shown in other FRs as well.
This package provides the required 5-year review under ORC 106.03 for all the hazardous waste management program’s rules that are subject to 5-year review. These reviewed rules didn’t contain any particular problems, but typos and other non-substantive errors are corrected. These rules are updated to address FR-related changes as well. There are also several no-change rules in this package.
