What does this rule package cover?
DDAGW has reviewed 3745-81-23, -24, and -26 of the Ohio Administrative Code (OAC) to satisfy the five-year rule review requirements of section 106.03 and 106.031 of the Ohio Revised Code. These rules set forth primary drinking water standards for inorganic, organic, and radionuclide monitoring requirements.
What step is this in the rulemaking process?
This step in Ohio EPA’s rulemaking process, required by Ohio Revised Code (ORC) 121.39, is called Interested Party Review. During this step, the Agency makes available draft rules for interested parties for review and comment. This step occurs after the Early Stakeholder Outreach comment period.
What changes are being considered?
3745-81-23 – amend
Removal of excess regulatory restrictions.
3745-81-24 – amend
Grammatical changes and fixing typos.
(A)(3) - change monitoring requirements for VOCs for new PWSs to require monitoring in the first full calendar quarter instead of the first quarter of the next calendar year.
(A)(13) – fix MDL for xylenes.
(C)(4) – add clarity to when the samples will be averaged (i.e., must be during the scheduled collection period).
(C)(11) and (12) – change to “all PWS must submit their SMP” instead of just surface water.

Adding an annual monitoring period for radiological monitoring.
